New Proposition 65 regulations for the rental housing industry take effect July 1, 2019. Proposition 65 requires every business with ten or more employees to provide warnings prior to exposing any person to a chemical known to the State of California to cause cancer and/or birth defects or other reproductive harm. The new regulations allow landlords to comply with the law by providing most warnings in the lease or through an annual written notice rather than posting warnings throughout the property. This webinar will provide a detailed review of Proposition 65 and the two new warning regulations.

In 2016 the Mountain View voters approved Measure V, the Community Stabilization and Fair Rent Act (CSFRA), which enacted a system of rent controls and eviction restrictions in the City of Mountain View. The CSFRA took effect on December 23, 2016. Under the CSFRA rent increases for covered units are tied to inflation, as measured by the Consumer Price Index.  The CSFRA also provides protections against eviction for tenants in covered units.

If you follow the news, you probably notice that California appears to be in a constant state of emergency. Whether due to fires, severe storms, earthquakes, or pandemics, both the Governor and local officials have declared countless states of emergency over the last several years. Those emergency declarations trigger a provision of the state’s penal code, called the state’s anti-price gouging law, which limits how much rental housing providers can increase rent. And those limitations apply not only to your existing tenants but also to new tenants even in units that are new to the rental market. A violation of this law is a misdemeanor and subject to significant penalties.

The COVID-19 Tenant Relief Act of 2020, commonly known as AB 3088, was passed by the California Legislature on Monday, August 31, 2020 and took effect immediately upon signature by the Governor. AB 3088 provides sweeping new protections from eviction for tenants unable to pay rent and other charges due between March 1, 2020 and January 31, 2021 due to circumstances directly related to the COVID-19 pandemic. It also extends the “just cause” protections of the Tenant Protection Act of 2019, commonly known as AB 1482, to all properties through January 31, 2021.
